Ashley St. Clair Sues Elon Musk for Sole Legal Custody of Their Son

Ashley St. Clair has filed a lawsuit against Elon Musk, seeking sole legal custody of their son, R.S.C. The custody petition was submitted to the New York Supreme Court on February 21. St. Clair states that New York is the child's home state.
According to St. Clair, Musk, 26, is the father of R.S.C., who was born in September 2024. The exact birth date remains confidential in the legal documents. In the petition, St. Clair reports that Musk was absent during R.S.C.'s birth. Additionally, she claims that he has only met their son three times and has not participated in his care or upbringing.
St. Clair filed a paternity petition alongside the custody request. She mentions that her romantic relationship with Musk began in May 2023. They had intercourse in January 2024, resulting in R.S.C.'s conception.

The petition details exchanges wherein Musk allegedly acknowledged his parentage. After R.S.C. was born, St. Clair sent Musk a photograph of the newborn. Musk purportedly responded, "I look forward to seeing you and him this weekend." The petition includes a screenshot of this exchange. St. Clair also mentions that amid discussions about safety, Musk indicated, "If I make a mistake on security, [R.S.C.] will never know his father," which she interprets as another acknowledgment of parentage.

Musk met R.S.C. for the first time on September 21, 2024. He reportedly spent two hours with them and followed up with one hour the next day. St. Clair asserts that Musk's most recent visit took place on November 30, 2024, when he spent only 30 minutes with R.S.C.
Prior to that meeting, Musk allegedly texted St. Clair on November 24, expressing, "I want to knock you up again." Three months later, Musk messaged her: "Well, we do have a legion of kids to make."
St. Clair's representative, Brian Glickich, stated, "Ashley has filed paternity and custody petitions to protect her child’s best interests. She has made every effort to collaborate with Mr. Musk before taking this step." Glickich added that St. Clair has no further comment as the petitions are self-explanatory.

In her filings, St. Clair has asked the court to issue a summons or order for Musk to present evidence and declare paternity, providing support and additional relief as deemed necessary.
St. Clair's attorney, Karen B. Rosenthal, noted in her affirmation that attempts have been made to address the matter privately with Musk's representatives. The law firm has faced unresponsiveness from Musk's side while attempting to resolve open issues regarding custody and support.
Rosenthal explained the difficulty in serving Musk at the White House due to security measures related to his former position in the Trump administration.

Musk is known to have 13 children with four women, which includes the child with St. Clair. This legal action follows a public appeal from Grimes, Musk's former partner, and mother of three of his children. On February 20, she urged Musk, via X, to respond about their child’s medical crisis. Grimes stated that Musk had not answered communication attempts and missed meetings concerning their child’s situation, which she indicated could lead to long-term impairment if left unaddressed.
