Jay-Z Seeks Dismissal of Anonymous Rape Lawsuit, Citing Legal Limitations
Jay-Z is exploring a new strategy after a judge ruled that his accuser could remain anonymous.
On December 30, attorney Alex Spiro submitted documentation aiming to dismiss a lawsuit alleging rape against Jay-Z. He argues that the alleged incident occurred before a December 2000 law enacted to assist victims of gender-motivated violence. This law was amended in December 2022 by the New York City Council, adding a two-year window for individuals to present historical claims beyond the previous statute of limitations.
Spiro wrote, "Plaintiff cannot recover for her sole claim under the Victims of Gender-Motivated Violence Protection Act (the GMV Law), as a matter of law, because the statute does not have retroactive effect." He highlighted that the incident purportedly occurred in September 2000, while the GMV Law was not in effect until three months later, asserting that it cannot retroactively support a legal claim.
In her lawsuit, filed earlier in December, the accuser, referred to as "Jane Doe," alleges she was raped by Jay-Z and Sean "Diddy" Combs during an MTV Video Music Awards afterparty in 2000 when she was only 13 years old. Both artists have denied these allegations.
Judge Analisa Torres recently stated that Jane Doe may retain her anonymity despite Jay-Z’s attempt to dismiss the case and reveal her identity. However, she indicated that this decision could change as legal proceedings advance. Torres characterized Spiro's approach as aggressive, suggesting he aimed to expedite the case.
Tony Buzbee, representing Jane Doe, remarked on the situation, stating, "I don’t typically comment on court rulings. The coordinated efforts to undermine my credibility as counsel are falling flat."
Meanwhile, Jay-Z, born Shawn Carter, and Buzbee find themselves in a separate legal struggle. Jay-Z accuses Buzbee of extortion and defamation, while Buzbee has counter-sued Jay-Z’s Roc Nation. This claim includes allegations that Roc Nation bribed Buzbee’s clients to file lawsuits against him and threatened former clients. In response, Roc Nation labeled Buzbee’s allegations as "baloney."
