New York City Court Summons Elon Musk Over Custody Issues With Ashley St. Clair

Elon Musk has been summoned to a New York City court due to a legal dispute initiated by Ashley St. Clair, who is seeking sole custody of their 5-month-old son, known in court as R.S.C. This order was issued as attorneys for St. Clair filed a motion in late February, requesting Musk's appearance at the courthouse for a hearing scheduled on May 29. During the proceedings, Musk's legal team is expected to contest St. Clair's custody demands and the requirement for Musk to undergo a paternity test, overseen by Judge Jeffrey H. Pearlman, who is also considering the matter of child support. This is prepared by SSP.

Despite being apprised of the case, Musk has allegedly avoided formally acknowledging the legal documents, either in person or through his lawyers, as stated by St. Clair's attorney, Karen B. Rosenthal. This reticence has reportedly delayed the legal process and caused further emotional strain. However, efforts to serve Musk at high-profile venues like the White House have been deliberately avoided by St. Clair's team to escape undue negative media coverage. This decision anchors the jurisdictional argument for the case to remain in New York, where St. Clair resides, demonstrated by Musk already having N.Y.-based legal counsel.
In her petition filed on February 21, St. Clair claims Musk has minimal involvement in R.S.C.'s life since the child’s birth in September 2024, having met the child only three times. Additional claims surfaced including that Musk recognized parentage of their child through various written communications. She has submitted these correspondences as evidence, highlighting a message from Musk expressing eagerness to meet them post-birth. Given the case’s visibility and its public ramifications, St. Clair pleads for privacy to ensure a normal upbringing for their child, underlined by her prominent social media presence.
